Customer Responsibilities for Shipments
As an eShipper user, you agree to:
- Provide accurate and complete shipment details, including recipient name, address, package dimensions, and declared value.
- Ensure that all shipments comply with carrier regulations, including weight limits, labelling, and packaging requirements.
- Verify shipping restrictions for prohibited or hazardous goods before booking.
- Pay all applicable duties, taxes, and customs fees for international shipments.
- Track shipments using the carrier’s tracking system and notify eShipper of any service issues promptly.
Failure to comply with these responsibilities may result in additional fees, shipment delays, or service suspension.
Intellectual Property
The intellectual property in the materials contained in this website are owned by or licensed to eShipper and are protected by applicable copyright and trademark law.
When you use our website or its associated services to post, upload, share, or otherwise transmit content covered by intellectual property rights, you grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide licence to use, distribute, modify, run, copy, publicly display, translate, or otherwise create derivative works of your content in a manner that is consistent with your privacy preferences and our Privacy Policy.
The licence you grant us can be terminated at any time by deleting your content or account. Even if eShipper or an authorized representative has been notified, orally or in writing, of the possibility of such damages, these limitations will still apply.

1. Informal Resolution:
If a dispute arises between you and eShipper, we encourage you to first contact our support team at support@eshipper.com to seek a resolution before pursuing legal action.
2. Mediation & Arbitration:
- Any dispute, controversy, or claim arising out of or in connection with these Terms of Service shall first be referred to mediation in Ontario, Canada.
- If mediation fails, the dispute shall be exclusively settled by binding arbitration under the rules of the Arbitration Act (Ontario).
- The arbitration shall take place in Toronto, Ontario, Canada, and the proceedings shall be conducted in English.
3. Class Action Waiver:
You agree to waive the right to participate in class actions and instead resolve disputes on an individual basis.
Accuracy of Materials

- eShipper does not directly control third-party shipping carriers (e.g., FedEx, UPS, Canada Post, etc.) and cannot guarantee their performance, delivery times, or service quality.
- Any claims related to lost, damaged, or delayed shipments must be filed with eShipper who is responsible to take this up with the respective carrier, subject to their terms and policies.
- eShipper is not liable for any service disruptions, fees, errors, or failures caused by third-party vendors, including but not limited to:
- Payment processing failures (e.g. credit card issuers).
- Delays in customs clearance.
- Carrier-imposed restrictions, surcharges, or penalties.

Customer Accounts & Security

Compliance with Canadian Consumer Protection Laws
eShipper complies with applicable Canadian consumer protection laws, including the:

- Consumer Protection Act (Ontario) – Protects consumer rights in contracts for services.

Severance

Force Majeure
eShipper shall not be held responsible for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to:

- Government actions (e.g., regulatory changes, embargoes, customs restrictions).

This clause does not excuse payment obligations for services already rendered.
Carrier Service Levels & Delivery Estimates
eShipper provides estimated delivery timeframes based on information from third-party carriers. However, you acknowledge that:
- Delivery times are estimates only and not guaranteed.
- Carriers may experience delays due to weather, customs processing, or operational disruptions.
- eShipper is not liable for any missed delivery deadlines, lost revenue, or inconvenience caused by delays.
For guaranteed delivery options, you must purchase carrier-specific insurance or expedited services where available.
Governing Law & Jurisdiction
These Terms of Service shall be governed by and interpreted in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.
By using our services, you:
Waive any objections to venue based on jurisdiction, inconvenience, or other factors.
Agree to submit to the exclusive jurisdiction of the courts in Ontario, Canada for any disputes.
eShipper Wallet Terms of Use
These Terms of Use (“Terms”) govern your access to, and use of the Wallet feature (“Wallet”) provided by eShipper, a division of Canada Worldwide Services Inc. (“eShipper”, “we”, “us”, or “our”). By using the Wallet, you agree to comply with these Terms, our general Terms & Conditions, and our Privacy Policy.
Eligibility
- To use the eShipper Wallet, you must be at least 16 years of age or the age of majority in your jurisdiction.
- Have a valid and active eShipper account and be authorized to use the preferred payment /funding method linked to your Wallet.
- Not be barred from using our services under applicable law.
- We may request additional information to verify your identity or eligibility before activating or allowing use of the Wallet.
Overview of the Wallet
The eShipper Wallet is a prepaid balance tool that allows users to deposit funds in advance to streamline payment processes and use stored value toward shipping.
You can view transaction history, balances, and fund usage in your eShipper account dashboard.
Important: The Wallet is not a deposit account, credit facility, or bank account. It does not accrue interest and is not insured by any financial regulator or institution.
We reserve the right to set minimum and maximum deposit amounts and may hold or delay fund availability for security or compliance reasons (e.g., fraud checks, unusual activity).
Loading Funds into the Wallet
You may add funds to your Wallet through:
- Credit cards
- Interac e-Transfer
- Electronic Funds Transfer (EFT)
- Wire transfer or other payment methods approved by eShipper
Using Wallet Funds
Funds in your eShipper Wallet can be applied toward: Shipment bookings, Freight and courier charges, Third-party carrier fees billed via the eShipper platform, Additional services such as insurance, storage, or brokerage
Restrictions:
- Wallet funds cannot be transferred to other users.
- Wallet balances cannot be used to pay for services outside the eShipper ecosystem.
- Wallet funds are not redeemable for cash, except as required by law or under the refund terms outlined below.
Fees, Deductions, and Charges
The use of the Wallet may be subject to:
- Service fees (e.g., shipping transactions or processing fees)
- Chargebacks or reversals (in case of payment disputes)
- Adjustments (e.g., for overcharges, reconciliation)
eShipper may deduct such amounts from your Wallet balance as they arise. A full record of all fees and deductions is available in your account dashboard.
Balance Management and Statements
You can view your Wallet balance and transaction history at any time by logging into your eShipper account. You are responsible for:
- Reviewing your Wallet activity regularly.
- Reporting any unauthorized or suspicious transactions within 30 days of the transaction date.
- Ensuring sufficient funds are available before placing a service order.
Refunds and Withdrawals
Wallet balances are non-refundable and non-transferable under normal use. In cases of account termination or duplicate deposits, users may request a refund by submitting a written request to accounting@eshipper.com. An interchange fee of 3% will be applicable if the refund payment method is a credit card.
Refunds will be issued to the original payment method whenever possible and are subject to verification and administrative processing. Refunds may take 5–10 business days to process and are only granted at eShipper’s sole discretion, unless otherwise required by applicable law.
Suspension, Misuse, and Termination
We reserve the right to suspend or close your Wallet in the event of:
- Fraudulent or suspicious activity
- Abuse of promotions or credits
- Use of the Wallet for purposes other than paying for eShipper services
- Violation of these Terms, our Terms of Service, Privacy Policy or any applicable laws
If your Wallet is suspended or terminated:
- You may lose access to your stored funds temporarily or permanently.
- Any remaining funds may be withheld or refunded, subject to investigation.
- Reinstatement is not guaranteed and is at eShipper’s sole discretion.
No Warranties & Limitation of Liability
The Wallet is provided on an “as-is” and “as-available” basis. eShipper disclaims all warranties, express or implied, including:
- Fitness for a particular purpose
- Accuracy, availability, and reliability of the Wallet
- Continuous or uninterrupted access
Liability Limitation:
To the maximum extent permitted by law, eShipper shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, business, or data
- Unauthorized access or errors caused by third-party systems or user negligence
Data Protection and Privacy
Use of the Wallet is subject to eShipper’s Privacy Policy, which governs how we collect, use, and protect your personal and financial data.
By using the Wallet, you consent to:
- Data processing necessary to operate the Wallet feature
- Secure storage of your financial activity in accordance with industry standards
Changes to These Terms
eShipper reserves the right to modify these Terms at any time. If changes are significant, we will notify you by email or via the platform.
Continued use of the Wallet after changes become effective constitutes your acceptance of the revised Terms.

Governing Law
